Clubes Puente (TAS) Concepto y Reglas Generales

Se produce un traspaso puente cuando se utiliza un club como puente intermediario en el traspaso de un jugador de un club a otro. El paso ficticio por este club se utiliza para eludir, por ejemplo, el pago de la indemnización por formación. El traspaso de un club puente tiene tres características principales:

(1) se realiza sin motivo deportivo aparente; (2) hay tres clubes implicados: (i) el club en el que el jugador fue inscrito en primer lugar, (ii) el “club puente”, normalmente un club de nivel inferior, (iii) el club final de destino; y (3) el jugador se compromete con el club puente durante un corto período de tiempo y frecuentemente no juega. A este respecto, la edición de 2020 del RSTP establece que se presumirá, salvo que se establezca lo contrario, que si se producen dos traspasos consecutivos, nacionales o internacionales, del mismo jugador en un periodo de 16 semanas, las partes (clubes y jugador) implicadas en esos dos traspasos han participado en una transferencia puente.

A bridge transfer occurs when a club is used as an intermediary bridge in the transfer of a player from one club to another. The fictitious passage through this club is used to circumvent, for example, the payment of training compensation. A bridge transfer has three main characteristics: (1) it is made for no apparent sporting reason; (2) there are three clubs involved: (i) the club where the player was firstly registered, (ii) the “bridge club”, usually a club of a lower level, (iii) the final club of destination; and (3) the player is engaged with the bridge club for a short period of time and frequently does not play. In this regard, the 2020 edition of the RSTP provides that it shall be presumed, unless established to the contrary, that if two consecutive transfers, national or international, of the same player occur within a period of 16 weeks, the parties (clubs and player) involved in those two transfers have participated in a bridge transfer.
